The petitioner seeks bail in Barachatti P.S. Case No. 249 of 2019, instituted for the offence under Section(s) 414 of Indian Penal Code.

Counsel for the petitioner submits that petitioner has no criminal antecedent. He has been falsely implicated in the instant case.

It is alleged in the written report that informant during patrolling duty received information that in Barachatti at Balti Bazar, one person has taken stolen Motorcycle. The informant along with police personnel reached at Balti Bazar and saw one Motorcycle. Petitioner was found standing near the Motorcycle. He did not produce the papers of the Motorcycle on

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. There is no recovery of Motorcycle from his possession.

Petitioner is in custody since 16.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati at Gaya, in connection with Barachatti P.S. Case No. 249 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
