The petitioner is apprehending his arrest in Excise Case No. 5 of 2011, registered for the offences punishable under Section 47(a) of Bihar Excise Amendment Act, 2016. Learned counsel for the petitioner submits that the alleged recoveries were made from the premises. On account of the fact that the petitioner was unwell and he was suffering from some neurological problem, he had entrusted the shop to another person. It is further submitted that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and nature of allegations made against the petitioner, let the petitioner
Patna High Court Cr.Misc. No.32566 of 2016 (4) dt.14-12-2016 2/2 in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bikramganj in connection with Excise Case No. 05 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
