JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehending her arrest in Gopalganj (Town) P.S. Case No. 133 of 2014 registered under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code, seeks privilege of pre-arrest bail.
In the FIR the allegation against the petitioner is that she along with Gumani Yadav and Vishram Yadav assaulted Ramaji Yadav with Lathi and Bas causing injury which proved fatal.
The submission on behalf of the petitioner is of false implication and that the petitioner is a lady and she has been implicated with oblique motive. The petitioner bears no specific allegation as to how she assaulted the deceased and hence, she
Patna High Court Cr.Misc. No.43022 of 2014 (2) dt.16-04-2015 2/2 deserves sympathetic consideration to which the learned A.P.P. opposes.
Considering that against the petitioner also there is allegation that she along with Gumani Yadav and Vishram Yadav assaulted Ramaji Yadav, who subsequently died due to the injury, I do not find it a fit case for grant of privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail to the petitioner is hereby rejected in Gopalganj (Town) P.S. Case No. 133 of 2014 pending in the Court of Chief Judicial Magistrate, Gopalganj.
