JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Munger Kotwali P.S. Case No.46 of 2014, disclosing offences under Sections 341, 342, 323, 379, 325 and 307/34 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioner, has submitted that upon medical examination, it was found that there was swelling over forehead of the

Patna High Court Cr.Misc. No.47552 of 2015 (2) dt.03-11-2015 2/2 informant. He has submitted that the petitioner has no criminal antecedent and no case, under Section 307 of the Indian Penal Code, is made out against him.

Be that as it may be, in the facts and circumstances of the case and considering the submission, aforesaid, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Munger Kotwali P.S. Case No.46 of 2014.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
