ANJANA MISHRA ORAL ORDER 12-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Barauni (Refinery) P.S. Case No.209 of 2011 for allegedly having committed the offence under Sections 147, 148, 149, 323, 324, 307, 302, 337 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though the petitioner is named in the F.I.R., yet no specific role has been assigned to him. It is further submitted that the allegation of firing is against others and not against this petitioner. Furthermore, the F.I.R. reveals that the allegation has been made that four persons fired indiscriminately but only

However, learned counsel for the petitioner submits that such an injury cannot be particularly attributed to the petitioner as there was indiscriminate firing.

In view of the aforementioned facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate,1st Class, Begusarai, in connection with Barauni (Refinery) P.S. Case No.209 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
