JUSTICE SANDEEP KUMAR ORAL ORDER 08-03-2022 Heard learned counsel for the petitioner and the State. Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner apprehends his arrest in connection with Gopalganj P.S. Case No. 293 of 2019 for the offences under Sections 342, 307, 379, 302, 120B/34 of the Indian Penal Code.

The petitioner is said to have participated in the killing of the deceased.

It has been submitted by learned counsel for the petitioner that two accused persons have specifically claimed to have given stab would and the petitioner is not one of them. He

Considering the aforesaid facts that the similarly situated accused persons have been granted anticipatory bail, this application is allowed for the reasons mentioned in Annexure-2 Series.

Let, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 293 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
