The petitioner is languishing in jail since 20.06.2015 in a case instituted under Sections 384, 387 and 307 /34 of the Indian Penal Code and Section 3/4 of the Explosive Substance Act and Section 27 of the Arms Act.
As per allegation, that on 04.12.2014, the petitioner along with other accused persons took meal and bill of the said meal was demanded, instead of paying the bill, accused persons demanded Rangdari of Rs.20,000/- from the informant. During course of said occurrence, firing and bombarding were made by the accused persons.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.35930 of 2015 (3) dt.05-10-2015 petitioner has got no criminal antecedent. He is in custody since 20.06.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. From perusal of the FIR, it would appear that no one is said to have been injured in course of the occurrence. Petitioner has falsely been implicated in the present case due to oblique reason. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction learned SDJM, Munger in connection with Munger Kotwali P.S.Case No.333 of 2014.
