The petitioner apprehends his arrest in Gandhi Maidan P.S. Case No. 113 of 2016 under Section 307 and other sections of the Indian Penal Code.

The informant alleged that he asked some questions from the teachers on such the petitioner took his person affront and asked the informant not to behave in such manner. On the next day when the informant came to class room, the petitioner assaulted him with knife on which the informant got blow on his hand and the second blow hit the teacher, Avinash, on his chest.

The learned counsel for the petitioner submits that the teacher has given altogether a different story that some verbal altercation took place between the informant and the petitioner and the petitioner on the next day attacked the informant with pencil cutter and the teacher also got injury by the pencil cutter, but, from the perusal of the first information report and the case diary, it appears that some verbal altercation took place a day before and on the next day the petitioner made dagger blow on the informant and when the teacher came to pacify the teacher also got injury on chest. Considering the facts and circumstances, I am not inclined to enlarge the petitioner, above named, on anticipatory bail and the same is rejected.
