The petitioners are in custody since 04.07.2017 in connection with a case registered for the offences punishable under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioners submits that that while the petitioners were in custody in connection with Pipra Kothi P.S. Case No. 53 of 2017, they were implicated in connection with the present case on the basis of their self confession and it is thus, that the petitioners are in custody. Having heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State, it appears that, though there is no T.I. Parade nor were they named in the First Information Report. The petitioners, on the basis of self confessional statement made before the Police which has no

In view of the aforementioned facts and circumstance, let the petitioner No. 1 (Shambhu Sah) and petitioner No. 2 (Suresh Sah), be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Sadar, East Champaran, Motihari, in connection with Rajepur P.S.
