ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 29.06.2019 in connection with Pakri Barawan P.S. Case No. 217 of 2019 registered for the offence under Sections 419, 420, 467, 468, 471, 472 and 120(b) of the Indian Penal Code and Section 66(D) of I.T. Act.

Learned counsel for the petitioners submits that the entire case is false and frivolous and has no basis whatsoever. It

The petitioners who are close family members have been taken into custody. It is further submitted that the said suspicion was raised only on account of previous enmity between these petitioners and other co-villagers. Learned counsel also submits that they are not having criminal antecedent and have been languishing in Jail. It has also been submitted by way of supplementary affidavit that the mother of petitioner no.1 is ailing with cancer and he is the only person to take her for further treatment.

Considering the aforementioned facts and circumstances and the remote nature of allegations made against the petitioners, let the petitioners, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the court of learned Judicial Magistrate, 1st Class, Nawada in connection with Pakari Barawan P.S.
