JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2017 Earlier prayer for bail of the petitioner was dismissed vide order dated 01.09.2017 passed in Cr. Misc. No. 36939 of 2017 with observation that petitioner may renew his prayer for bail after framing of charge in this case.
Submission of learned counsel for the petitioner is that now charge has been framed in this case and petitioner has been in custody since 06.06.2017 and is ready to abide by any condition imposed on him for grant of bail.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts as well as in view of the order dated 01.09.2017 passed in Cr. Misc. No. 36939 of 2017, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Siwan in connection
Patna High Court Cr.Misc. No.50696 of 2017 (3) dt.29-11-2017 with S.Tr. No. 510 of 2017 arising out of Barharia P.S. Case No. 12 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner shall not make any threat to the informant.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
