The petitioner seeks regular bail in connection with Angarh P.S. Case No. 05 of 2019 for the offences punishable under Section 392 of the Indian Penal Code.
The allegation is regarding the petitioner and other accused persons having intercepted the informant and his brother and having snatched their mobile and motorcycle. The learned counsel for the petitioner submits that neither any recovery has been made from the possession of the petitioner nor the petitioner has been put on T.I. Parade, hence the complicity of the petitioner has not been established on the basis of the materials available on record and he cannot be said to have committed the alleged occurrence. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 31.05.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Angarh P.S. Case No. 05 of 2019.
