2. The petitioner is seeking regular bail in connection with Narpatganj P.S. Case No. 599 of 2023 for the offences punishable under Sections 341, 323, 354, 376, 420, 506/34 of the Indian Penal Code.

3. As per allegation, the petitioner used to establish physical relation with the informant (a divorcee) on the false pretext of marriage.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the alleged victim is a married lady. Her husband prior to the present case had lodged a case against the petitioner for kidnapping of his wife (the present victim) in which the statement under Section 164 of the victim recorded and she had flatly refused the factum of kidnapping. He has also submitted that the petitioner is under

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Narpatganj P.S. Case No. 599 of 2023, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(i) The petitioner shall cooperate in the disposal of the trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates, without any reason or unavoidable circumstances, the learned court below shall be at liberty to cancel his bail bond.
