JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Dagarua Police Station Case No. 158 of 2015, disclosing offences under Sections 147, 148, 149, 323, 307, 386, 427, 504 of the Indian Penal Code.

Allegedly, a vehicle, bearing Registration No. BR-11L/0971, was crossing Toll Plaza, at Barsoni. When the employee of the Toll Plaza stopped the said vehicle, the persons sitting in the vehicle called the petitioner, who immediately came and threatened the employees of the Toll Plaza and assaulted them. It is also alleged that thereafter again, 10-12 persons, including the present petitioner,

Patna High Court Cr.Misc. No.36757 of 2016 (2) dt.08-09-2016 2/2 armed with weapon, came to the said Toll Plaza and they damaged the structures of Toll Plaza and the furniture. Considering the nature of allegation, I am not inclined to grant the petitioner privilege of anticipatory bail. This application for anticipatory bail, is hereby, rejected.

The petitioner, Ajit Sarkar, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
