JUSTICE ARUN KUMAR ORAL ORDER 14-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sikandra P.S.Case No. 46 of 2017 registered under Sections 304B and 201/34 of the Indian penal Code.
Allegation in brief is that informant's daughter was married in the year 2016 with the petitioner and after marriage, she was being tortured for further demand of dowry and it is alleged that on 07.04.2017, by pouring kerosene oil over her body set fire and was killed and her dead body was disposed of. Learned counsel for the petitioner submits that FIR itself discloses that informant is not the eye witness and it is said that on 07.04.2017 deceased was killed, but he learnt about the occurrence on 11.04.2017, in fact, the fact is that the deceased had committed suicide and her dead body was also disposed of in
Patna High Court Cr.Misc. No.57855 of 2017 (2) dt.14-12-2017 2/2 presence of her parents.
Having considered the facts and circumstances of the case, nature of offence and petitioner being the husband, the prayer for bail of the petitioner stands refused. (Arun Kumar, J) Sujit/- U T
