JUSTICE MUNGESHWAR SAHOO ORAL ORDER 05-10-2016 Heard learned counsel for the petitioners and learned counsel for the informant and also learned A.P.P. for the State. Petitioners, namely, Prashant Kumar Singh @ Pintu @ Prashant Kumar @ Prashant, Arjun Singh, Rajesh Singh and Rajhans Mehta apprehend their arrest in Sasaram Town P.S. Case No.688 of 2016 under Sections 147, 149, 341, 384, 427, 504 and 506 IPC and Section 27 of the Arms Act.
From perusal of the F.I.R., it appears that the allegation is that the petitioners and other co-accused persons came to the place where the informant parties were filling up soil and asked
Patna High Court Cr.Misc. No.38637 of 2016 (3) dt.05-10-2016 them to stop the work and demanded Rs.15 lacs and threatened that until the amount is paid, they will not be allowed to carry on work on the land.
According to the learned counsel for the petitioners, there is land dispute between the parties. Admittedly the informant parties and the present petitioners are co-sharers and there is dispute with regard to the suit property. The informant parties claimed that the suit property is their land whereas the petitioners claimed that it is their land.
Considering the above facts and circumstances of the case, I direct the petitioners named above to surrender before the court below within 28th of October, 2016 and on their so surrendering before the court below, the court below is directed to release them on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram in connection with Sasaram Town P.S.
