Petitioners seek bail in connection with Shekhopur Sarai P.S. Case No. 98/2017 for offences punishable under Section 419, 420, 467, 468, 471/34 of the Indian Penal Code. The prosecution case, as lodged by the police personnel, is that on secret information that in the garden of one Ram Chandra Mahto some miscreants are cheating the people on the pretext of the scheme "Chehra Pahchano Inam Pao", the police arrived at the place and apprehended the petitioners while they were trying to flee away. From the possession of the petitioners mobile phones, for which no papers were produced, and some
Patna High Court Cr.Misc. No.49587 of 2017 (2) dt.02-11-2017 2/3 papers were recovered which had photographs of some persons. Accordingly, a seizure-list was prepared.
It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal history and have been falsely implicated in the aforesaid case. He submits that none of the witnesses have come forward alleging any offence against the petitioners and that they are languishing in judicial custody since 05.09.2017.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-I, Sheikhpura, in connection with Shekhopur Sarai P.S. Case No. 98 of 2017, subject to the conditions that :
(i) One of the bailors would be a close relative of the petitioners having sufficient immovable property, who will file an affidavit stating his relationship with the

(ii) If the petitioners indulge in an offence of similar nature in future, the prosecution will be at liberty to move the learned court below for cancellation of their bail bonds. (iii) The petitioners will cooperate with the investigation and not induce or tamper with the witnesses.
