JUSTICE SUDHIR SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 409 and 120B/34 of the Indian Penal Code. Prosecution case is that when informant was loading money in the ATM of State Bank of India, the driver fled away with rest of the amount and petitioner has been found to be an accused in the case.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 20.3.2015. Chargesheet has been submitted in the case against the petitioner. There is no allegation of tampering with the evidence. He has been made accused due to mistake of fact. The other co-accused have been granted bail vide Cr. Misc. no. 23129 of 2015 and Cr. Misc. no. 15317 of 2015.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.30321 of 2015 (5) dt.07-10-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Refinery)P.S. Case no. 484 of 2014.
