JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sahar Police Station Case No. 27 of 2016 registered for the offences punishable under Sections 149, 148, 323, 325, 379, 307 of the Indian Penal Code.
Petitioners are named in the first information report with specific allegation that they along with others participated in the alleged crime.
Submission on behalf of the petitioners is that there is case and counter case between the parties and persons from both the sides sustained injuries. The aforesaid submission goes to
Patna High Court Cr.Misc. No.45177 of 2016 (2) dt.22-12-2016 2/2 show the participation of the petitioners in the alleged crime. In my view, it is not a fit case for grant of anticipatory bail and, accordingly, their prayer for anticipatory bail in connection with Sahar P.S.Case No. 27 of 2016, pending in the court of Additional Chief Judicial Magistrate, Bhojpur at Ara stands rejected.
However, this order shall not cause any prejudice to the concerned court at the time or consideration of regular bail application of the petitioners.
