The petitioner seeks bail in Sessions Case No. 331 of 2017 arising out of Maheshkhunt P.S. Case No. 50 of 2017 registered under Section 366/34 of the Indian Penal Code. Co-accused Nibha Devi and Sarita Devi are said to have kidnapped married daughter of the informant and the petitioner Panchanand Singh and one Akhilesh Singh are said to have been visiting the house of the informant with bad intention on her daughter and on protest made by her extended threatening of kidnapping her daughter.

It is submitted by learned counsel for the petitioner that there is no allegation of kidnapping against the petitioner in

No.51468 of 2017 (4) dt.21-12-2017 2/2 the F.I.R. rather only allegation is of extending threatening of kidnapping on protest made by the informant on his visit to her house. There is no eye witness of the occurrence. There is no cogent material indicating the complicity of the petitioner in the occurrence. The petitioner has been falsely implicated in the case merely on suspicion. As a matter of fact, the deceased was a deserted lady and had eloped with co-accused Akhilesh Singh who has been residing in Bangalore. During the course of investigation, I.O. has also found Akhilesh Singh and the victim Mamta Devi absconding on raiding the house of the accused Akhilesh Singh. The petitioner has been languishing in custody since 02.06.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned F.T.C. 1st, Khagaria in connection with Sessions Case No. 331 of 2017 arising out of Maheshkhunt P.S. Case No. 50 of 2017.
