This is an application for bail in connection with Chenari P.S. Case No. 174 of 2016, registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant causing grievous injury to her on thigh. Submission of learned counsel for the petitioner is that as a matter of fact the informant is wife of petitioner and some occurrence took place with respect to sale and purchase of land of the family. Further submission is that though injury is grievous but in this case an affidavit has been filed by informant showing that good sense has prevailed between the parties and further petitioner is in custody for four months.

Having heard both sides and in view of facts and

No.49626 of 2017 (2) dt.09-11-2017 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Shri Pankaj Mishra, Additional Chief Judicial Magistrate-cum-S.J.-III, Rohtas at Sasaram, in connection with Chenari P.S.Case No. 174 of 2016, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
