Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sirdalla P.S. Case No. 366 of 2021 lodged under Sections 354(D), 504, 506/34 of the I.P.C. read with Section 8 of the POCSO Act.

As per the prosecution case, the F.I.R. has been lodged by the informant alleging therein that the petitioner has used his Facebook account to make the objectionable photographs of the daughter of the informant with him and made it viral. On the basis of which, the father of the victim has

Learned counsel for the petitioner submits that the said viral photographs are the part of the F.I.R. For joint photographs of petitioner with the alleged victim, he is in custody since 04.07.2022. He has having clean antecedent. Counsel further submits that Section 8 of the POCSO Act has not been attracted in the present case. Counsel submits that the F.I.R. has been lodged after delay of 23 days. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cumSpecial Judge POCSO Act, Nawada in connection with Sirdalla P.S. Case No. 366 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
