The petitioner seeks bail in Hilsa P.S. Case No. 411 of 2016 registered under Section 406, 420/34 of the Indian Penal Code.
As per the prosecution case, petitioner is said to have not returned the golden chain and ring of the informant despite payment of all the dues to him claiming arrear of interest of Rs.23494/- due against him.
It is submitted by learned counsel for the petitioner that the occurrence is of the year 2013 but the informant has lodged this case after long span of time of three years without explaining such abnormal delay. The petitioner had also filed a Complaint Case No.550/16 against the informant, his brother
Patna High Court Cr.Misc. No.50104 of 2017 (02) dt.17-10-2017 2/ 2 Dhiraj Sharma and also against his father one day preceding to the institution of the present case. The petitioner has been languishing in custody since 17.08.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Hilsa P.S. Case No.411 of 2016.
