JUSTICE SANDEEP KUMAR ORAL ORDER 10-04-2025 By way of this application, the petitioners have prayed for the following reliefs:- "(a) For issuance of an appropriate writ in the
Patna High Court CR. WJC No.1587 of 2023(2) dt.10-04-2025 2/2 nature of certiorari for quashing the F.I.R. bearing Meenapur P.S. Case No.653 of 2022 dated 31.12.2022 attributing offences under section 379 of the Indian Penal Code.
(b) For issuance of an appropriate writ in the nature of mandamus, commanding and directing the respondent authority to make the proper verification to genuineness of signature put on written statement of the informant and if the signature of the informant is found forged then take appropriate action against the respondents."

As per the F.I.R. allegation against the petitioners is that they have stolen the motorcycle of the informant and are using the same.

From reading of the F.I.R., cognizable offence are made out against the petitioners. In my opinion, the F.I.R. cannot be quashed considering the defence of the petitioners. Accordingly, this criminal writ application is dismissed.
