Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of three cases and allegation is of recovery of 105 litres of liquor kept concealed under husk near the house of the petitioner along with 2 litres codeine cough syrup from betel shop of Amrul.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and he came to be implicated based on secret information which is the easiest way

Patna High Court CR. MISC. No.59067 of 2024(2) dt.06-09-2024 2/2 to implicate someone and even alleged recovery is from a place which is accessible to public at large and does not belong to the petitioner and petitioner is in custody since 2-7-2024. 5.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Palasi P.S. Case No. 93 of 2024.
