The petitioner seeks bail in connection with Riga P.S. Case No. 319 of 2020 instituted for the offences under Sections 302 and 34 of the Indian Penal Code. Learned counsel submits that the police after investigation submitted charge-sheet under Sections 306 and 34 of the I.P.C.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.04.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. The informant alleges that the petitioner along with Sundariya Devi and Champa Kumari @ Ruchi Kumari strangulated the daughter of the informant to death as she refused to work on asking of Sundariya Devi.

No.66836 of 2021(2) dt.10-03-2022 2/3 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, the informant in his restatement has stated that he was not present in the house when the occurrence took place. It is further submitted that the witnesses have stated that the deceased committed suicide as she was assaulted on her private parts by the accused persons, learned counsel further submits that the deceased had earlier also tried to commit suicide but was unsuccessful. Learned counsel submits that that the police after investigation submitted charge-sheet under Sections 306 and 34 of the Indian Penal Code. Learned counsel submits that during the course of investigation it has come that the deceased committed suicide and as far as allegation of strangulating the victim is concerned, that gets belied from the investigation made by the police and also that informant was not an eye-witness to the occurrence as he has stated in the restatement.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, the petitioner is a person with clean antecedent and the police after investigation submitted charge-sheet under Sections 306 and 34 of the I.P.C.,

Case No. 319 of 2020.
