1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 148, 326, 302, 342 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that his brother was well acquainted with the accused persons including the petitioner and they often used to sit together. It is next alleged that accused persons earlier had threatened his brother that he would be killed. It is further alleged that on 14.10.2023, the informant received an information that his brother has been killed and accordingly, he

No.60376 of 2024(3) dt.11-12-2024 2/3 reached the place of occurrence and saw the dead body of his brother and thus, based on suspicion alleges that accused persons including the petitioner, who are involved in seeking extortion from dealer of sand, killed his brother along with other unknown persons.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant based on suspicion when he is not an eye witness to the occurrence and the petitioner is in custody since 05.02.2024. It is further submitted that similarly situated co-accused Pintu Ray was granted the privilege of anticipatory bail by an order dated 04.09.2024 in Cr. Misc. No.55757 of 2024. It is further submitted that charge-sheet has been submitted as such, no useful purpose would be served by keeping the petitioner in jail.
5. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of Miss Kanchan Prabha, learned J.M.F.C., Danapur, Patna in connection with Shahpur P. S. Case No.665 of 2023.

7. The application stands allowed.
8. However, in the event, if the learned trial Court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial Court shall forthwith cancel his bail bonds after recording reasons and shall take all coercive steps to ensure that petitioner is behind bar.
