Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is in custody in a case registered under Sections 304(B),201,34 of the Indian Penal Code. The allegation against the petitioner and other coaccused is of killing the daughter of the informant for non fulfilment of additional demand of dowry.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.01.2015. The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence
Patna High Court Cr.Misc. No.38523 of 2015 (3) dt.08-10-2015 2/2 against the petitioner. From perusal of paras 6,7,9 and 37 of the case diary it would appear that no one was at home and the deceased had locked the door inside the room and committed suicide. Subsequently the door was broken by the villagers from outside and they tried to save her but she succumbed to the injuries.
On behalf of the State, it has been submitted that the petitioner is named in the FIR and husband of the deceased. Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Desh Mukh, learned J.M., 1st Class, Jehanabad in Kinjer P.S.Case No. 47 of 2014.
