JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-10-2018 Earlier the petitioner was granted provisional anticipatory bail for a period of four months vide order dated 27.8.2018 passed in Cr.Misc.No. 35876 of 2018 and petitioner was directed to deposit Rs.4 lakhs in four instalments.

Submission of learned counsel for the petitioner is that financial position of the petitioner is not good and as such he is unable to pay the same and the order may be modified with liberty to the petitioner to deposit Rs.1 lakh at the time of surrender by way of cheque.

However, considering the facts and circumstances that the order was passed in the presence of other side counsel, as such I am not inclined to interfere with the said order. Hence, this

Patna High Court Cr.Misc. No.65302 of 2018 (2) dt.31-10-2018 2/2 application is dismissed.

However, petitioner may surrender and pray for regular bail, which shall be considered on merit, without being prejudiced by this order.
