The petitioner is in custody in a case registered under Sections 366A/34 of the Indian Penal Code.
It is alleged by the informant that accused Vicky enticed away his minor sister with an intention to marry her and one Chhotan Kumar helped Vicky in this act.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.5.2015. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the evidence against the petitioner.
From perusal of para 18 of the case diary it appears
Patna High Court Cr.Misc. No.38571 of 2015 (3) dt.08-10-2015 2/2 that the victim was arrested along with co-accused Vicky at Delhi by Faridabad police at the instance of the police, who had gone from Bihar. As far petitioner is concerned, it is alleged that he has helped the victim and co-accused Vicky who eloped for the purpose of marriage. From perusal of Annexure 2 it appears that the victim has been married to co-accused Vicky. On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in Fatehpur P.S.Case No. 145 of 2015.
