2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.
3. There is total recovery of 182.42 litres of Indian made foreign liquor from the car and motorcycle.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on the basis of confessional statements of coaccused persons, namely, Sachin Kumar Singh and Pankaj Kumar. Nothing has been recovered from conscious possession of the petitioner. The alleged illicit liquor or seized vehicles does not belong to the petitioner. Similarly situated co-accused
Patna High Court CR. MISC. No.57487 of 2025(2) dt.03-09-2025 2/2 persons, namely, Pankaj Kumar and Sachin Kumar @ Sachin Kumar Singh have already been granted regular bail by this Court and a coordinate bench of this Court vide orders dated 21.08.2025 and 13.08.2025 passed in Cr.Misc.No.57103 of 2025 and Cr. Misc. No.55468 of 2025 respectively. Petitioner has one criminal antecedent in which he is on bail. Petitioner is in jail since 18.07.2025. Petitioner undertakes to cooperate in the investigation and the trial.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Judge, Saran at Chapra in connection with Revilganj P.S. Case No.233 of 2025.
