2. In the present case, the petitioner seeks bail in connection with Sheikhpura P.S. Case No. 122 of 2025 registered for the alleged offences under Sections 115(2), 126(2), 109, 352, 351(2), 3(5) of B.N.S.

3. As per prosecution case, the petitioner and other coaccused persons entered into the house of the informant and the petitioner gave garasa blow on the head of the informant. When the nephew and father of the informant came for her rescue, they were also assaulted. The occurrence took place in the background of earlier instituted case which was registered for the murder of the brother of the informant and the assailants were asking the informant to compromise the said case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The present case has been lodged with intent to harass the petitioner and also to create pressure upon the petitioner. Learned counsel further submits that the petitioner is not involved in the murder case of the brother of the informant. However, the petitioner is having antecedent of one case registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act vide Sheikhpura P.S. Case No. 192 of 2023. Learned counsel further submits that the injury of the informant is stated to be simple caused by hard and blunt substance which falsifies the allegation of giving garasa blow to the informant by the petitioner. The petitioner is in custody since 07.05.2025 and charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that the injury has been caused on the vital part of the body though the injury is stated to be simple.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the simple nature of injury, period of custody of the petitioner and submission of charge sheet, the petitioner above named is

No.56518 of 2025(4) dt.19-11-2025 3/3 directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura/concerned Court in connection with Sheikhpura P.S. Case No. 122 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
