JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Earlier petitioners and others have preferred Cr.Misc.No. 44600 of 2018 for granting anticipatory bail, which was permitted to be withdrawn by learned counsel for the petitioners on instruction vide order dated 31.7.2018. Submission of learned counsel for the petitioners is that under misconception the earlier application was withdrawn and so far petitioners are concerned, they are agents of nonbanking company and no specific allegation has been attributed against them.
Heard learned APP also, who has opposed the prayer for anticipatory bail stating that petitioners are named in the FIR and there is allegation of committing fraud against them with
Patna High Court Cr.Misc. No.68558 of 2018(2) dt.12-12-2018 2/2 the informant and others and petitioners are said to be the main accused in this case.
Having heard both sides and the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners.
However, petitioners are directed to surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
With the above observation, this application is dismissed.
