Petitioner seeks bail in a case registered for the offences punishable under Sections 328, 307, 379, 411, 34 of the Indian Penal Code Sections 20/22 of the NDPS Act. According to prosecution case, some unknown passenger served some intoxicant to the informant and took away his belongings including money. On the next day, co-accused Naushad Alam was noticed at railway station and from his possession some of the stolen articles were recovered. Naushad Alam has already been allowed bail by a Coordinate Bench of this Court in Cr.Misc.No. 26032 of 2017. Petitioner is in custody since 06.01.2017. Considering the period already undergone by the

No.60684 of 2017 (4) dt.20-03-2018 petitioner as well as grant of bail to co-accused Naushad Alam, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with N.D.P.S. Case No.92 of 2017 arising out of Rail Siwan (Thawe) Police Station Case No.01 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
