Petitioner seeks bail in connection with Jhajha P.S. Case No. 15 of 2004 registered for the offences punishable under Sections 302, 380/34 of the Indian Penal Code. Allegedly co-accused Guddu Singh and Prayag Yadav caught hold the husband of the informant and then the petitioner shot the husband of the informant in his chest as a result of which he fell down and died.
Submission is of false implication and that the petitioner is not the co-villager. He is the son-in-law and he is suffering in custody since 04.10.2014, having no criminal antecedent.
Patna High Court Cr.Misc. No.26065 of 2015 (3) dt.08-10-2015 2/2 The learned A.P.P. opposes the prayer of bail by submitting that the petitioner is the main assailant. In the facts and circumstances stated above, considering that the petitioner is the main assailant, I am not inclined to release him on bail. The prayer for bail stands rejected. However the trial court is directed to expedite the trial by taking the same on priority basis and keeping the same on day to day basis.
