Petitioner apprehends his arrest in connection with Navinagar P.S. Case No.133 of 2016 for the offence registered under section 7 of the E.C. Act.
Petitioner happens to be P.D.S. dealer and the accusation against him is that he did not maintain stock register properly and furthermore, it is alleged that he did not supply the items to consumers according to the allotment but submission on behalf of the petitioner is that so far as non-maintenance of stock register is concerned, the said offence appears to be bailable and so far as non-supply of items to bonafide consumers is concerned, the petitioner distributed the items to consumers in accordance with
Patna High Court Cr.Misc. No.44982 of 2016 (2) dt.08-12-2016 2/2 supply made to him.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M. Ist, Aurangabad in Navinagar P.S. Case no. 133 of 2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
