The petitioner seeks bail in anticipation of his arrest in connection with Bodh Gaya P.S. Case No. 637 of 2017 dated 13.11.2017 instituted for the offences under Sections 147, 148, 149, 324, 326, 307 and 302 of the Indian Penal Code.

After some arguments, Mr. Manish Kumar No. 2 learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail petition in order to enable the petitioner to surrender before the court below and seek regular bail.

In case such a petition is filed within a period of four weeks from today, the court below shall take into account all relevant facts including that the mother of

No.69118 of 2018(2) dt.18-12-2018 2/2 the petitioner had earlier filed a case against the informant of this case and that the petitioner is not alleged to have touched the body of the deceased but is only alleged to have assaulted the informant, and shall pass orders in accordance with law without being prejudiced by the fact that the present petition has not been entertained by this court.

The petition is dismissed as withdrawn.
