JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 07.03.2017 in connection with Danapur P.S. case no. 123 of 2017, registered under Sections 399,402,414 and 413 of the I.P.C and Sections 25(1-b)a, 26/35 of the Arms Act. On secret information, the police arrested the petitioner and several others from a lonely place. From the possession of the petitioner, one loaded country made pistol and few cartridges were recovered.

Learned counsel submits that two other accused persons were also arrested with fire arm have been granted bail vide order dated 6.10.2017 passed in Cr. Misc. no. 47329 of 2017 even after noticing the criminal antecedents. It is stated that co-

Patna High Court Cr.Misc. No.50966 of 2017(2) dt.09-11-2017 2/2 accused, namely, Manager Kumar @ Manager Rai has also been granted the privilege of bail vide order dated 6.11.2017 passed in Cr. Misc. no. 51428 of 2017.

Mr. Dayal learned APP opposed the prayer and submits that the petitioner has few criminal antecedents. In view of the above, this Court is inclined to release the petitioner on bail. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I Danapur /concerned Court, in connection with Danapur P.S. Case No. 123 of 2017, subject to the condition that one of the bailors of the petitioner shall be his own/close family member and no sooner the charges are framed in the case, the petitioner shall appear in person on each date fixed at the trial. In case of default on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
