JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 This modification application has been filed for modification of order dated 26.06.2019 passed in Cr. Misc. No. 73865 of 2018, by which, the prayer of the petitioner for grant of anticipatory bail was disposed of with direction to him to appear in the court below 08.07.2019 and the opposite party no. 2 was also directed to remain present in the court below on that date. Submission of learned counsel for the petitioner is that due to flood in the village, they could not appear as per the direction of this Court and thus prayed for modification or order dated 26.06.2019 passed in Cr. Misc. No. 73865 of 2018 and for extension of time.

No. 73865 of 2018 is modified only to the extent that let petitoner appear before the court below within a period of two weeks' from the date of receipt of a copy of this order in the court below and at the time of appearance, he will also ensure the appearance of opposite party no. 2 in the court below and once both the parties appear, the learned court below shall pass an appropriate order in terms of order dated 26.06.2019 passed in Cr. Misc. No. 73865 of Accordingly, this modification application disposed of. Let a copy of this order be communicated to the concerned court below forthwith.
