The petitioner in the present case is seeking regular bail in connection with Chautarwa P.S. Case No.106 of 2000 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Sections 27(1) of the Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case because of the group rivalry. He is in custody since 06.11.2013. Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein there is specific allegation of commission of overt act against the petitioner by which son of the informant was killed and
