The petitioner is accused in connection with Complaint Case No. 3808 of 2012 under section 420, 465 and 467 of the Indian Penal Code.
The prosecution case is that accused Ram Lagan Rai sold his 11 katha 10 dhur of land of plot no. 42 and 64 in favour of his father Hiraman Rai and uncle Bhukhlu Rai and after the death of Bhukhlu Rai, his four sons also came in possession. Due to non-publication of khatihan, no survey plots number were detailed in the sale deed. Knowing about the sale deed executed by accused Ram Lagan Rai in favour of father and uncle of the complainant, the petitioner and his three brothers Jatan Rai, Satan Rai, Ratan Rai and Bhaktan Rai got executed the sale deed in
Patna High Court Cr.Misc. No.51517 of 2015 (2) dt.22-12-2015 respect of 49 decimal of the said land to the accused Ram Lagan Rai, in which, Kuldip Rai and Ram Naresh Rai have put their signature.
The learned counsel for the petitioner submits that the petitioner along with three brothers is bonafide purchaser of the land in dispute. It is further submitted that the petitioner has been falsely implicated in this case and is in custody since 03.09.2015. Having regard to the facts and circumstances of the case, the petitioner Satan Rai is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Complaint Case No. 3808 of 2012.
