The petitioners apprehend their arrest in Chandauti P.S. Case No. 208 of 2019, registered for the offences punishable under Sections 307, 379 of the Indian Penal Code. As per the prosecution case, the informant gave Rs. 3,07,000/- to the co-accused Vijay Yadav for purchase of a piece of land, but co-accused Vijay Yadav did not register the land in favour of the informant and said that he will return the money. Patna High Court CR. MISC. No.67608 of 2021(3) dt.25-07-2022 2/2 other co-accused persons surrounded him and Vijay Yadav assaulted him by means of rod, co-accused Dhananjay Yadav assaulted him by means of Khanti and other co-accused assaulted him by means of lathi, danda.

It is submitted that petitioners have been falsely implicated in this case due to land dispute. FIR was lodged after delay of 12 days without any plausible explanation. Moreover, case has been compromised between the parties. Petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S. Case No. 208 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
