JUSTICE SUDHIR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in a case registered under Sections 406, 420, 467, 120(B)/34 of the Indian Penal Code. It is alleged by the informant that the informant being the Incharge Principal of the Middle School, Nawadih, Silphari issued a cheque of Rs. 10,000/- in favour of Amit Ram (petitioner) in lieu of supply of certain books in school but subsequently the informant found that from the account with regard to money for purchase of uniform for the students Rs. 3,10,000/- was withdrawn.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 25.6.2015. Charge sheet has been submitted in

Patna High Court Cr.Misc. No.39726 of 2015 (3) dt.13-10-2015 2/2 this case. There is no allegation of tampering with the evidence against the petitioner. The petitioner has been made accused in this case due to mistake of fact. Further, it has been submitted that the petitioner is ready to deposit an amount of Rs. 20,000/- (twenty thousand) in the court below, which shall be subject to final disposal of the case.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, the petitioner is directed to deposit an amount of Rs. 20,000/- (twenty thousand) in the court below, which shall be subject to final disposal of the case.

Let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in Chakai P.S.Case No. 175 of 2011. (Sudhir Singh, J) singh/- U T
