Petitioner is in custody in connection with Sadar P.S. Case No. 230 of 2019/G.O. Case No. 587 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act 2016.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
Learned counsel for the petitioner submits that in the instant case total 219 liters of liquor was seized. The petitioner is in custody since 13.6.2019. Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,
Patna High Court CR. MISC. No.52155 of 2019(2) dt.22-08-2019 2/2 let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise, Darbhanga, in connection with Sadar P.S. Case No. 230 of 2019/G.O. Case No. 587 of 2019 subject to the condition that petitioner shall deposit Rs. 50,000/- (Fifty Thousand) cash in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event of acquittal the amount shall be refunded to the petitioner otherwise the amount shall be forfeited.
