The petitioner is in custody in a case registered under Sections 153(A), 295(A), 120(B), 506, 387/34 of the Indian Penal Code.

One message was received from mobile no. 8083988879 by which threatening to blow Bodh Gaya temple was given. On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. He is in custody since 23.7.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. As per prosecution case, SIM card, which is said to have been used in the crime had been purchased from the shop of

Patna High Court Cr.Misc. No.39715 of 2015 (3) dt.13-10-2015 2/2 this petitioner. There is no allegation that the petitioner had sold the said SIM card on a fake document. Except for this there is no other material against the petitioner.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR. The name of the petitioner has come in course of investigation.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Gaya in Bodh Gaya P.S.Case No. 238/2015.
