The petitioner seeks bail in Atri P.S. Case No. 316 of 2020, registered for the offence under Sections 341, 323, 326, 307, 34 of the Indian Penal Code.

As per the prosecution case, this petitioner abused and assaulted the informant and his wife, as a result of which, wife of the informant sustained injury on her head and her teeth was also broken.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case in retaliation to the counter case filed on behalf of petitioner, vide Atri P.S. Case No. 313 of 2020. It is further submitted that the injury report does not support the prosecution case and he is in custody since 10.07.2021.

Patna High Court CR. MISC. No.66446 of 2021(2) dt.28-02-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XIII, Gaya in connection with Atri P.S.
