2. In this case, the petitioner is seeking regular bail in connection with Excise (Sherghati) P.S. Case No. 105 of 2024, registered for the offences punishable under Section 30(a) and 32(c) of Bihar Prohibition and Excise Act.
3. As per allegation, on the basis of a secret information, the informant along with along with other police personnel reached near Bus stand G.T. Road Sherghati, apprehended the petitioner with a Maruti Suzuki car. Thereafter, in course of search, total 172.80 litres illicit liquor has been recovered from the vehicle.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.58894 of 2024(2) dt.27-08-2024 2/2 that the petitioner is innocent and has falsely been implicated. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is under custody since 08.07.2024 and he is a person of clean antecedents.
5. On the other hand, learned APP has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court No. 4, Gaya in connection with Excise (Sherghati) P.S. Case No. 105 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
