This is a petition for grant of regular bail for offence under Section 395 of the Penal Code.

There is allegation that this petitioner earlier come to the shop of the informant and asked for 20-25 bread biscuit and when the informant refused that there is no material he will give the same on the next day on which he was threatened and, then, it was alleged that he came along with four persons. All the four were concealing their faces, except the petitioner and they looted Rs.90,000/-. The learned counsel for the petitioner submits it is highly improbable that this petitioner, if threatened, will come without concealing the face to commit dacoity and, further, the petitioner is in jail since 18.12.2014.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Dighalbank P.S. Case No. 65 of 2014 to the satisfaction of the Chief Judicial Magistrate, Kishanganj.
