The petitioners are apprehending their arrest in a case registered under Sections 307, 323, 324/34, 341, 379 of the Indian Penal Code.

The prosecution case, in brief, is that all the accused persons armed with deadly weapon, chased the informant and as a result of which, the informant fell in course of fleeing and the accused persons assaulted him.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.67180 of 2018(2) dt.27-11-2018 2/2 petitioners. The petitioners have been falsely implicated in the present case. There is case and counter case between the parties. The injury on the side of the accused has not been explained by the prosecution.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Rosera, Samastipur in connection with Hasanpur P.S. Case No. 178 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
