The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Dhaka P.S. Case no. 106 of 2021 instituted for the offence punishable under Sections 414/34 of the Indian Penal Code. Prosecution case relates to recovery of four stolen motorcycles from the garage of the petitioner from where three accused persons were apprehended and two managed to escape. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner has no concern with the recovered motorcycles rather the same were brought by the co-accused persons for repairing. He has got no criminal antecedent and he

Learned APP appearing for the State has opposed the prayer of bail and submitted that four motorcycles were recovered from the garage of the petitioner and he is indulged in theft business. Apart from this fact, seizure list witnesses have supported the prosecution case during investigation. Having heard learned counsel for the parties and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
